The registration fee is paid only if the mark is accepted and no opposition succeeds. Fees are the same for each class: a mark in three classes needs three applications.

The official trademark registration fee in Pakistan is Rs 3,000 per class to apply (form TM-1) and Rs 9,000 per class to register (TM-11), so one mark in one class costs Rs 12,000 in IPO fees, or Rs 13,000 with the optional Rs 1,000 search. Every class is a separate application, so the total grows with each class and each mark.

These are the main fees in the First Schedule to the Trade Marks Rules 2004, as revised by the Commerce Division notification of 4 March 2019.

Collective marks (TM-3), certification marks (TM-4), textile marks (TM-53) and applications claiming priority from a convention country (TM-2) carry the same Rs 3,000 application fee per class.

How the fee adds up

  1. Search (optional), Rs 1,000 per class. A search of the register on form TM-55 shows whether a similar mark is already there before you spend on an application.
  2. Application, Rs 3,000 per class. Form TM-1 covers one mark in one class. Three classes need three applications.
  3. Registration, Rs 9,000 per class. Paid only at the end, when the mark has been published in the Trade Marks Journal, no opposition has succeeded, and the Registry sends a demand notice.
  4. Renewal, Rs 15,000 per registration every 10 years, with Rs 900 more for late payment.

A lawyer or registered trademark agent charges a professional fee on top. That is not set by law, so enter the quote you have if you want it in the total.

Worked examples

One brand name in one class, with a search. Search Rs 1,000 + application Rs 3,000 = Rs 4,000 at filing. Registration Rs 9,000 later. Total: Rs 13,000.

A word mark and a logo, each in three classes, no search. That is 6 applications. At filing: 6 x Rs 3,000 = Rs 18,000. On acceptance: 6 x Rs 9,000 = Rs 54,000. Total: Rs 72,000. Renewing all six after 10 years would cost Rs 90,000 at the current fee.

Renewing three registrations late. 3 x (Rs 15,000 + Rs 900) = Rs 47,700.

Steps and timing

The IPO-Pakistan guidance sets out the path after filing:

The registration is valid for 10 years from the filing date, not from the date of the certificate, and can be renewed every 10 years.

Trademark fee questions

What is the trademark registration fee in Pakistan?

Rs 3,000 per class to file the application (TM-1) and Rs 9,000 per class to register once accepted (TM-11), so Rs 12,000 for one mark in one class. An optional search costs Rs 1,000 per class. A lawyer's or agent's fee is extra.

How much does it cost to register a trademark in 3 classes?

Three classes are three applications: 3 x Rs 3,000 at filing and 3 x Rs 9,000 on acceptance, Rs 36,000 in all. With a search in each class, add 3 x Rs 1,000.

When do I pay the trademark registration fee?

Only at the end. You pay the application fee when you file. The registration fee is paid after the mark is published in the Trade Marks Journal and the two-month opposition period passes, when the Registry sends a demand notice. If the mark is refused, the registration fee is never due.

How long is a trademark valid in Pakistan?

10 years from the filing date. It can be renewed for further periods of 10 years, at Rs 15,000 per registration, with Rs 900 extra for late payment. A mark removed from the register can be restored on form TM-13 for Rs 3,000.

Is the fee different for online filing?

No. The IPO-Pakistan fee schedule has one fee for each form, whether you file through the online system or on paper at a Registry office. Online filing needs a SELF or REPRESENTATIVE user account.

How much does a trademark search cost in Pakistan?

Rs 1,000 for each class on form TM-55. It is optional, but it shows whether an identical or similar mark is already on the register before you pay the application fee.
